PIC Realty Corp and Tejano Farms Delaware, INC.,Appellants, v. Southfield Farms, INC., and Easterwood Farms, LTD.

A court case regarding a land owner and a tenant occurred in Corpus Christi, Texas on May 7th, 1992. This is a brief summary of the case.

Easterwood Farms sued PIC Realty Corp for failure to pay for services rendered that benefited the land leased by the tenant prior to obtaining a renewed lease on the property and during a period under which an already existing lease remained. The jury concluded in favor of Eastwood Farms.

The appellants, PIC Realty Corp, argued six points against Eastwood Farms. The following outlines the arguments and their outcomes.

Point one states that the appellants states that Eastwood did not abide by quantum meruit. According to the definition of quantum meruit submitted by the trial court, the point made by the appellants was overruled.

The second point made by the appellants argues that the jury questions were submitted erroneously on the lines of quantum meruit and unjust enrichment. A contract validates questions on quantum meruit. Also, since unjust enrichment relies on a quasi-contract, and is closely related to quantum meruit, the second point was overruled.

Thirdly, appellants questioned the existence of legally or factually sufficient evidence. Since the jury only considers evidence that supports the verdict, it is objective by nature. Furthermore, due to custom, Easterwood was under the impression that they would be compensated for the work done on the land regardless of the renewal of the lease. This point was also overruled.

For the fourth point, appellants claimed that fraud and promissory estoppel lacks sufficient evidence. Since the appellees received no money for this point, it was determined void, and the point was overruled.
