Business Ethics, Law, and Regulations
Ethics, laws, and regulations with considerations of control, taxation, and liability of three scenarios, are discussed in this paper. The first scenario describes a hiring manager for a construction company determining the best candidate to fill a position based on several factors. The second scenario describes the opening of a bar/restaurant by three people. The bar/restaurant must comply with all laws, ethics, and regulations that may apply. The third scenario explains a wealthy man interested in opening a small chain of exterminating businesses. It must be determined how he will successfully open his business following all laws, ethics, and regulations.
Construction Scenario
Mei-Lin is the manager of Surebuild Inc. looking to hire a person to fulfill a jackhammer position. The description of the position states the individual needs a high school diploma. Four people applied for the position. Of the four there was Michelle, former jackhammer operator with a high school diploma, but appears to be pregnant. She cannot be discriminated against due to her pregnancy, per the Pregnancy Discrimination Act amended Title VII of the Civil Rights Act of 1969 (EEOC, 2008). However, Michelle would not be able to successfully fulfill the essential job functions of the position as it could do harm to her pregnancy. She would not be a likely candidate for the position.
Nick is a college graduate with no jackhammer experience who also has epilepsy. He is protected against discrimination of his epilepsy by the Americans with Disabilities Act of 1990. However, his condition is irrelevant to the fact as though he would not be a likely candidate for the position due to the fact he has no experience operating a jackhammer. Another applicant,
