Assignment 6
Joshua Betancourt
Assignment 6
American Public University System
Human Resource Management- HRMT 413
15th November 2014
Learning is one of the most important factors of a workplace environment as it provides an experience which is to be remembered for a life time and even shared with many people around us. Everyone faces a situation where the options available to him either seem impossible or there is a very low possibility of creating a win-win situation for everyone.
Currently in the military, discipline is one of the most important experiences which are required to be followed by every military officer. One of the positive experiences I had from the military point of view is that of the imposition of Article 15 available under the Uniform Code of Military Justice (UCMJ). In this article disciplinary penalty is imposed by a Commanding Officer which can be refused by the soldier through requesting trial by court-martial. These disciplinary penalties are basically imposed for minor problems only and sometimes are used by military personnel to prevent severe punishment to any soldier or officer.
Once my colleague together with me breached a military which was not meant to be broken by us but was committed due to a misunderstanding of the rule. Our Commander imposed Article 15 on both of us with a penalty which was refused by my colleague but not me. It is worth noting that accepting an Article 15 imposition is not an admission of being guilty. As I didn’t know the rule completely I accepted the punishment but my friend without consulting any attorney refused the punishment which resulted in a more severe punishment for him as we broke the rule by interpreting it differently.
This experience made me learn that if you are not sure of the legal repercussions or implications or you think that interpretation by the judges might be very different which could result in severe penalties, it is better to accept lower level punishment and research on your own mistakes.

Most infractions of the UCMJ can be dealt with by nonjudicial punishment. Nonjudicial punishment is Article 15 of the UCMJ. The authority of commanders to give an Article 15 is found in Article 15 of the Uniform Code of Military Justice. An Article 15 is considered non-judicial punishment, because it is not a judicial proceeding. Non-judicial punishment is a military justice option available to commanders. It permits commanders to resolve allegations of minor misconduct against a soldier without resorting to higher forms of discipline, such as a court-martial. The commander has complete discretion about whether to impose an Article 15. A soldier may, however, refuse to accept the Article 15 and instead demand trial by court-martial. (Powers, Nonjudicial Punishment)…

Rhinos must be saved because is the right thing to do. Rhinos might not have intrinsic value to humans as other people are anthropocentric.
