STATEMENT OF JURISDICTION

This Court has jurisdiction in this matter pursuant to the

Alabama Rules of Appellate Procedure 4(a), as the trial
court's order granting the appellee's Motion for Summary
Judgment is immediately appealable. Summary judgment was
granted on May 26, 2006. Appellant Barbara Morrison timely
filed her appeal on June 16, 2006 within forty-two (42) days of trial court' s order.

STATEMENT OF THE CASE

This case arises out of the wrongful death of Blake
Spivey, the minor son of Barbara Spivey. On October 17, 2004, Blake Spivey was killed in an automobile accident in Henry
County. Ritchie Spivey, Blake's father was the driver and
operating the vehicle with a blood alcohol content one and
half times over the legal limit (.123) and at a high rate of speed (75-79 mph) in a 45 mile per hour zone.
On July 25, 2005, Barbara Morrison, individually and as
mother of Randall Blake Spivey, deceased, filed suit against Patricia T. Spivey, as the administratix of the Estate of
