Alternative Dispute Resolution for Learning Teams
Learning Teams are responsible for collaborating, completing, and submitting assigned coursework on a very compressed schedule. Any dispute between team members can affect the quality and completion of assigned coursework and needs to be resolved within 48 hours from the time the dispute occurred. The team should use an Alternative Dispute Resolution (ADR) method to resolve disputes. The team should first use the ADR form of negotiation.
Negotiation. This ADR enables the team members to negotiate to try to reach an agreement and voluntarily settle the dispute (Cheeseman, 2009). The learning team leader will schedule a conference call or an online chat forum within 24 hours of the time of the dispute to start the negotiation process. All team members will participate in the discussion. They will hear both sides of the dispute, discuss options, alternatives, and possible compromises to enable the team to come to a voluntary settlement of the dispute. If negotiation does not provide a resolution the team should escalate to the ADR form of mediation.
Mediation. This ADR uses a neutral third party to assist the disputing parties in resolving their dispute (Cheeseman, 2009). The mediator is usually an expert in the subject area pertaining to the dispute (Cheeseman, 2009). The course instructor will be assigned as the mediator for learning team disputes that cannot be resolved with negotiation. The learning team leader will contact the course instructor, state the nature of the dispute, and set up meeting within 24 hours to hear the learning team members.
