Abstract:
Alternative dispute resolution refers to different ways in which to resolve conflict. Within any group effort, there will always be differences of opinion and disagreements. At times, the conflict may appear to be irreconcilable. At the group's inception, all parties involved, should agree to include an alternative dispute resolution clause into their charter or by-laws to help to resolve the conflict, should it arise. Some types of ADR are arbitration, mediation, negotiation, and mini trial, to name a few. When deciding to add the ADR clause to the team charter, the group will also decide which method will be best for their purposes. To avoid spells of non-productivity, loss of time or money, and even disbanding of the group, ADR can prove very effective.
Learning Team Conflicts
The team will manage conflicts of a personal nature, on a personal basis. The team members in conflict will take the initiative to resolve the conflict among themselves. If the conflict cannot be resolved between the members in conflict within a timely manner, and the working relationship of the team is compromised, ADR will be put into effect. Team conflicts that may be subject to ADR include:
Lack of participation from any team member
Lack of communication through the Learning Team Forum or e-mail
Not completing assigned responsibilities or tasks
Late submissions
Poor performance
Alternative Dispute Resolution Methods
In the event that one or more of these conflicts arise, the methods of resolution will be mediation and if necessary, arbitration. If one of the above conflicts occurs between team members, the first step to resolution will be mediation. In the mediation process, a third-party mediator will be chosen and agreed upon by the team members. The mediator will hear both sides reasonings for conflict and render a suggestion as to how to resolve the conflict.
