Deregulation

All modes of travel have experienced great changes through the years. Those changes were the government getting out of the travel management business and allowing the free market to determine the course of these modes of travel. The following will describe in simplistic form the effects of deregulation on each mode of travel.
Airline Deregulation: The Airline Deregulation Act of 1978 removed government control over fares, routes and creation of new airlines. The Civil Aeronautics Board (the governing body on airlines during regulation) powers of regulation were removed thus allowing the industry to be exposed to market forces. The Act, however, did not remove or diminish the regulatory powers of the Federal Aviation Administration (FAA) over all aspects of air safety. Airline deregulation has enabled more competitive pricing and increased carrier flexibility. Prior to deregulation, airline pricing was regulated by the Civil Aeronautics Board. Additionally, air routes were also controlled tightly. With more freedom, carriers can offer more effective options to those who wish to use airfreight as a means of shipment.
Railway deregulation: Railroad Revitalization and Regulatory Reform Act of 1976 eased regulations on rates, line abandonment, and mergers. Four years later, Congress followed up with the Staggers Rail Act of 1980. The most important features of the Staggers Act was that it allowed greater pricing freedom, and simplified merger processes. Finally, it expedited the line abandonment process, allowing multi-modal ownership, and permitting confidential contracts with shippers. Deregulation allowed railroad companies to change their business model from passenger to freight.     Similarly, the economic issues in the industry are also mostly concerned with deregulation. The evolution of industry structure plays an important role in determining the robustness and stability of lower airfares in unregulated markets (2000). Deregulation also keeps airline fares so low as compared to that of other countries. The reason for this is because despite the failure of most entrants since deregulation, investors continue to create new airlines. There is substantial evidence that entry, particularly by low-cost, low-fare airlines, has a substantial effect in constraining fare levels in markets served by the new carriers (2000). The second reason is that some in the industry have argued that financially marginal carriers may act in ways that depress prices below competitive levels, inducing contagion in financial distress (2000). In addition, some industry participants have argued that financially distressed carriers have cut prices in an effort to raise short-term cash, depressing market prices below efficient levels and threatening the financial security of healthy carriers. Another economic concern is the fact that the airline economy of the US is in a huge upset after the September 11 attack.     The Motor Carrier Act of 1935 was added as an amendment to the Interstate Commerce Act (ICA), which originally created the Interstate Commerce Commission to regulate the railroad industry. Because of the country’s dire economic situation the ICC immediately began to regulate the motor carrier industry in an effort to strengthen and stabilize the industry. The ICC instituted new carrier requirements: certificates, tariffs, and route restrictions. For example, all carriers were required to obtain a "certificate of public convenience and necessity" from the ICC. This was easy for carriers already operating in 1935. They could automatically get certificates if they documented their prior service. However the regulations adversely affected new carrier companies, who often found it extremely difficult to obtain certificate approval (Moore, 1993). Thus, regulations began to immediately cause a restriction in carrier operations.     Railroads have already been around for twenty years, but by 1850 there are more than nine thousand miles of track (“Railroads” 1). The eastern side of the United States has already been adopting railroads as their main source of transportation. States such as New York, Philadelphia, and Michigan have interconnected their railroads they had specifically only in their states. Chicago then joined the new trend having a connection of railroads from the east. These railroads reached all the way to the Mississippi (1).
